英文版劳动合同,受法律保护吗?
合法合规的劳动合同,在我国境内签订的,应该都是受保护的。
劳动合同无效的条件:
一、以欺诈、胁迫的手段或者乘人之危,使对方在违背真实意思的情况下订立或者变更劳动合同的;
二、用人单位免除自己的法定责任、排除劳动者权利的;
三、违反法律、行政法规强制性规定的。
一些劳动合同,譬如劳务合同很多不属于劳务纠纷,一般只能申请民事诉讼:
《关于确立劳动关系有关事项的通知》【劳社部培亮数发〔2005〕12号】
一、用人单位招用劳动者未订立书面劳动合同,但同时具备下列情形的,劳动关系成立:
(一)用人单位和劳动者键信符合法律、法规规定的主体资格;
(二)用人单位依法制定的各项劳动规章制度适用于劳动者,劳动者受用人单位的劳动管理,从事用人单位安排的有报酬的劳动;
(三)劳动者提供的劳动是用人单位业务的组成部分。
二、用人单位未与劳动者签订劳动合同,认定双方存在劳动关系时可参照下列凭证:
(一)工资支付凭证或记录(职工工资发放花名册)、缴纳各项社会保险费的记录;
(二)用人单位向劳动者发放的“工作证”、“服务证”等能够证明身份的证件;
(三)劳动者填写的用人单位招工招聘“登记表”、“报名配首表”等招用记录;
(四)考勤记录等。
英文版劳动合同是否受法律保护?
《劳动法》、《劳动合同法》以及《劳动合同法实施条例》均未对劳动合同订立所使用的语言作出限定。
此外,《宪法》第4条规定,各民族都有使用和发展自己的语言文字的自由。
原则上,法不禁止则自由。由此,劳动合同所使用的语言并不影响劳动合同的法律效力。

If Party A finds Party B is unqualified during the probationary period, Party A can dissolve the contract and pay the Party B salaries according to his/her actual working time. At the end of the probationary period, if neither party raises any objection, then Party B shall become a regular employee of Party A and will enjoy the treatment as specified by Party A.
4. 劳动合同期满,即行终止。经当事人协商同意续签合同时,应当于合同期满前三十(30)天内办理续签手续。
This Contract shall be terminated on the expiration date. If both parties agree to extend this Contract after consultation, the parties shall go through the extension formalities within thirty (30) days prior to the expiration of the term.
第二条 工作岗位、工作职责
Article 2 Working Position and Working Responsibility
1. 甲方安排乙方在 部门从事 工作。乙方必须按照确定的岗位责任,按时、按质、按量完成工作。
Party A assigns Party B on the position of and in the department of . Party B shall abide by his/her working responsibilities, and fulfill his/her duties assigned by Party A within the specified working time and ensure the quality of the work.
2. 甲方根据生产经营需要,依照乙方的能力和工作表现,可与乙方协商调整乙方的工作。但未经甲方书面批准,乙方必须服从甲方对其工种、岗位的安排。
Party A could change Party A’s work due to the needs of production and operation and the performance of Party A. Without the written approval of Party A, Party B must abide by the arrangement of Party A.
第三条 工作时间
Article 3 Working Hours
1. 甲方实行每周工作五天,每天工作8小时(不含1小时午餐休息时间),每周工作时间不超过40小时的工作制。工作时间为:星期一到星期五,每天上午9:00到下午6:00。
Party B’s normal work days per week shall be five(5) days from Monday to Friday and be no more than 40 hours, and the normal working hours per day shall be eight (8) hours(excluding one hour lunch time and rest time) from 9 a.m. to 6 p.m.
2. 根据业务需要,甲方可适当调整乙方工作时间,包括更改乙方的上下班时间和午餐休息时间。
Party A could adjust Party B’s working hours, including adjusting Party B’s duty time,lunch time and rest time, due to the needs of production and operation.
3. 甲方可根据需要安排乙方出差。对此,甲方按员工手册的规定向乙方支付津贴。
Party A may arrange Party B to go on errands due to the needs of Party A. Party A agrees to pay party B travel allowance as specified in the “Employee Handbook”.
第四条 工作条件、劳动保护
Article 4 Working Conditions and Labor Safety
1. 甲方为乙方提供符合国家和上海市规定的安全卫生的工作环境,保证乙方在人身安全及人体不受危害的环境条件下工作。甲方对乙方进行劳动安全卫生教育,防止劳动过程中的事故,减少职业危害。
Party A must provide to Party B a safe, hygiene working environment which complies with the provisions of the State and Shanghai and ensure that Party B will work under the working conditions where personal injuries will not be caused to Party B. Party A shall provide labor safety and hygiene education for Party B in order to prevent the industrial accident and reduce the occupational hazards.
2. 甲方根据乙方岗位的实际情况,按照国家和上海市规定向乙方提供必要的劳动防护用品。乙方的劳动保护待遇按国家和上海市有关规定执行。
Party A shall offer Party B the necessary occupational safety and health protection and working tools and provide labor protection treatment for Party B according to the relevant regulations of the State and Shanghai.
3. 乙方在劳动过程中必须严格遵守甲方制定的安全操作规程和劳动纪律。
Party B shall strictly abide by the safety rules and disciplines made by Party A.
第五条 劳动报酬
Article 5 Remuneration
1. 乙方在甲方工作期间,甲方根据“按劳分配”的原则,每月按甲方规定的形式和考核办法确定乙方的劳动报酬,以现金人民币向乙方支付劳动报酬。
During the term of this Contract, Party A shall pay Party B in the principle of “distribution according to one’s performance” monthly salary in cash and Renminbi according to the stipulations and the evaluation method of Party A.
2.乙方的劳动报酬由基本工资和保密费组成,保密费金额为基本工资金额的 %。在试用期内乙方的劳动报酬(包括基本工资及保密费,下同)为每月(大写人民币) 元,正式录用后为每月(大写)人民币 元。甲方实行新的薪酬制度或乙方的工作岗位、职务发生变化时,乙方的劳动报酬按新的制度予以调整。
During the probationary period, Party B’s monthly salary is yuan.
After that, the monthly salary is yuan per month. When Party A adopts a new salary standard, Party B’s salary will be adjusted accordingly.
3. 甲方同意按每年十二个月向乙方支付劳动报酬。若乙方为上一年十二月之前正式在册之员工,甲方在下一年一月份发年终双薪。若乙方在上一年度工作不满一年,年终双薪根据实际工作时间按比例计算。
Party A agrees to pay party B twelve monthly salary per year plus an extra month salary paid at the first month of the next year. If Party B’s time of service is less than one year, the extra monthly salary will be paid in accordance with Party B’s actual working time.
4.甲方在每月五日以现金形式支付乙方劳动报酬。
The payment of salary shall be made on the 5th day every month in cash.
5.甲方按照本劳动合同的规定向乙方支付劳动报酬或其他款项时,甲方将依照国家税法的规定代为扣缴个人所得税并上缴税务部门。
Party A shall withhold Party B’s personal income tax from monthly salary and other incomes of Party B when Party A pays to Party B according to this Contract. Party A shall turn the withheld tax to the tax authorities according to the Tax Laws of the State.
6.根据中华人民共和国及上海市政府的法律、法规,由乙方支付的养老保险、医疗保险、失业保险及住房公积金等社会保险、福利费用,也将由甲方根据有关法律、法规的规定代为扣缴。
According to the laws and regulations of the state and Shanghai, Party A shall withhold the endowment insurance, medical care insurance, unemployment insurance and public accumulation for housing construction for Party B.
7. 甲方原则上不鼓励乙方加班,若确因工作需要加班的,应由甲方部门经理发出书面加班通知,或由乙方提出加班申请并得到部门经理书面同意,符合上述条件的加班,甲方将另行安排乙方补休或者支付加班劳动报酬。
In principle, Party A will not encourage Party B to work overtime. In case Party B shall have to work overtime as far as considered necessary. Party B shall make application for work overtime and get the prior written consent of his/her department manager. As to the overtime work being in accordance with the foregoing conditions, Party A shall arrange for Party B to have an equal amount of leave or pay for Party B’s overtime work.

二、甲方由于生产经营需要经与工会和乙方协商后可以延长乙方工作时间,一般每日不得超过一小时;因特殊原因需要延长工作时间的,每日不得超过三小时,但每月不得超过三十六小时。甲方依法保证乙方的休息休假权利。
2. Due to its operational needs, Party may extend Party B’s working hours upon consultation with the Trade Union and Party B, provided that the extended working hours for a given day should generally not exceed one hour. If an extension of working hours is necessary for special reasons, the extended working hours for a given day should not exceed three hours, provided that the extended working hours for a month should not exceed 36 hours. Party A shall ensure that Party B will receive their rest and leave entitlements according to the law.
第四条 劳动报酬及支付方式与时间
Article 4 Work Remuneration, Payment Method and Date of Payment.
一、乙方试用期间的月劳动报酬为 元。
1. The monthly remuneration payable to Party B during the probationary period shall be RMB___________.
二、试用期满后,乙方在法定工作时间内提供正常劳动的月劳动报酬为 元,或根据甲方确定的薪酬制度确定为 。
2. After the expiration of the probationary period, the monthly remuneration for Party B’s performance of his normal labor obligations within statutory working hours shall be RMB_______, or RMB ____ determined under Party A’s remuneration policies.
乙方工资的增减,奖金、津贴、补贴、加班加点工资的发放,以及特殊情况下的工资支付等,均按相关法律法规及甲方依法制定的规章制度执行。甲方支付给乙方的工资不得低于当地最低工资标准。
Party B’s wage increase/decrease, bonuses, allowances and subsidies, and overtime wages, as well as the wage payment in special circumstances, shall be governed by relevant laws and regulations and Party A’s internal rules and policies. The wages paid by Party A to Party B shall not be less than the minimum wage standard stipulated by the people’s government where the employer is located.

Party a and Party B must participate in social insurance and pay social insurance premiums on a monthly basis in accordance with the law. The amount payable by Party B shall be withheld by Party B from the Party A’s monthly wages.
第六条 劳动保护、劳动条件和职业危害防护
Article 6 Labor Protection, Working Conditions and Protections Against Occupational Hazards
甲乙双方都必须严格执行国家有关安全生产、劳动保护、职业卫生等规定。有职业危害的工种应在合同约定中告知,甲方应为乙方的生产工作提供符合规定的劳动保护设施、劳动防护用品及其他劳动保护条件。乙方应严格遵守各项安全操作规程。甲方必须自觉执行国家有关女职工劳动保护和未成年工特殊保护规定。
The Parties must strictly implement relevant national occupational safety, labor protection and occupational sanitation procedures and standards. Any job exposed to occupational hazards shall be specified in the contract, and Party A shall provide Party B with work safety and hygiene facilities, labor protection equipment and other necessary conditions for Party B’s work activities. Party B must strictly comply with the work disciplines, operating procedures and safety rules set by Party A. 第七条 劳动合同变更、解除、终止
Article 7 Modification, Cancellation and Termination the Employment Contract
一、经甲乙双方协商一致,可以变更劳动合同相关内容。变更劳动合同,应当采用书面形式。变更后的劳动合同文本由甲乙双方各执一份。
1. The Parties may modify relevant terms of the Employment Contract where they have agreed to do so through mutual consultation and agreement.
二、经甲乙双方协商一致,可以解除劳动合同。
2. The Parties may terminate the Employment Contract where they have agreed to do so through mutual consultation and agreement.
三、乙方提前三十日以书面形式通知甲方,可以解除劳动合同。乙方在试用期内提前三日通知甲方,可以解除劳动合同。

四、甲方有下列情形之一的,乙方可以解除劳动合同:

4、规章制度违反法律、法规的规定,损害乙方权益的;
4. Where Party A’s policies violate laws or regulations, thereby infringing upon Party B’s rights and interests;
5、以欺诈、胁迫的手段或乘人之危,使乙方在违背真实意思的情况下订立或者变更劳动合同致使劳动合同无效的;
(5) Where Party A has concluded or modified the Employment Contract against the true intentions of Party B through the use of fraud, coercion or exploitation of the unfavorable position of Party B, as a result of which this Agreement is deemed null and void; or
6、法律、法规规定乙方可以解除劳动合同的其他情形。
(6) Other circumstances for termination by Party B as specified under laws and regulations.
甲方以暴力、威胁或者非法限制人身自由的手段强迫乙方劳动的,或者甲方违章指挥、强令冒险作业危及乙方人身安全的,乙方可以立即解除劳动合同,不需事先告知甲方。
Party B may terminate the Employment Contract with immediate effect and without advance notice to Party A If Party A uses violence, intimidation, or an unlawful restraint of individual freedom to compel Party B to work, or if Party A instructs Party B to violate the law or engage in hazardous work that endangers his personal safety.
